Janice L. Miller

After spending many years as a Court Investigator and reviewing General and Limited Conservatorships for the Probate Court, I am particularly interested in helping the elderly avoid conservatorship for as long as safely possible. I offer affordable consultation at a reduced rate of $100.00 / hour to evaluate and advise elderly clients to help my clients avoid financial elder abuse BEFORE the need for a conservatorship if possible or to seek alternatives to conservatorship if appropriate. By making it affordable for elderly clients to seek assistance, clients can feel comfortable in allowing me to come into their residence to evaluate needs regarding risk of financial abuse, neglect, or undue influence that can lead to conservatorship. If conservatorship appears to be unavoidable, I will make appropriate referrals.

For elderly client couples with a Trust, I can assist in avoiding conflict of interest for the drafting attorney when the need for independent representation arises. Trust attorneys may wish to have an independent (and affordable) attorney advise clients who are unsure or resistant to allowing their Successor Trustee to take over duties. With my unique skills and experience, I can analyze the situation and advise the elderly client.

For those with adult Developmentally Disabled loved ones, I offer the affordable rate of $100.00 / hour for guidance through the process of acting in pro per to obtain Limited Conservatorship of the loved one. I assist in filling out the paperwork and provide guidance and support through the process.

For clients who prefer not to represent themselves in court, I offer full representation for obtaining Limited Conservatorship for Developmentally Disabled loved ones. Representation in court is not at the reduced fee noted above and is billed in accordance with statutory requirements.

For families with trust administration disputes, I provide mediation, advice, and guidance at a reduced fee. My goal is to help clients avoid litigation if appropriate, however, I will make referrals if litigation is necessary.
