Payment of Towing and Storage Fees


Small Claims Court often entertains lawsuits involving towing disputes. Issues occasionally arise regarding the amount and type of payment for towing charges. A vehicle owner or his agent may seek statutory damages when specific procedures are not complied with in regard to payment of towing and storage fees.


Vehicle Code Section 22658 (h) provides for a limit on charges when a vehicle tow is not completed. The code section states that in the event that the owner or the owner's agent returns to his vehicle before it is removed, a towing company may impose a charge of not more than one-half of the regular towing charge for release of the vehicle.


Additionally, Section 22658 (k) specifies acceptable forms of payment for towing and storage charges. Operators of towing storage facilities are required to accept a valid bank credit card or cash payment when the registered owner or the owner's agent seeks the release of his vehicle. Operators refusing to accept payment made with a valid bank credit card are liable to the registered owner of the vehicle for four times the amount of the towing and storage charges. These statutory damages, however, are limited to $500.


Moreover, Section 22658 (k) mandates that owners or operators of storage facilities carry sufficient cash on the storage facility premises during normal business hours in order to make change for reasonable monetary transactions for payment of towing and storage fees. Failure to adhere to this provision allows the registered vehicle owner to pursue an action for consequential damages resulting from the facility's noncompliance.

FBA GOLF

TOURNAMENT


Dan Bacal has coordinated another golf tournament aka, the "4-person scramble." The tournament is scheduled for Thursday, September 8, 2005 and begins at 1:00 p.m. at the Cottonwood Golf Course. Tickets are $75.00 (pending notice per Dan) per golfer and include green fees, cart, beer cart, hats and food. Of course, "fabulous prizes" will be awarded to the winners. Additional information will be provided in future newsletters but in the meantime, please contact Dan Bacal at 588-2064 if you have any questions.

This activity has been approved for MCLE credit by the State Bar of California in the amount of 1.0 hour General Participatory. The FBA certifies this activity conforms to the standards for approved education activities prescribed by the rules and regulations of the State Bar of California governing mandatory minimum continuing legal education.

FAMILY LAW SECTION


The next meeting is tentatively scheduled for Tuesday, June 21, 2005 from 11:45 a.m. to 1:15 p.m. in the Jury Lounge on the ground floor of the El Cajon Superior Court. Food is allowed and you are invited to bring your brown bag lunch.


The speaker will be Marc P. Kaplan, Esq./CPA who will discuss how to understand self-employed, partnership and corporate tax returns to determine income for support. He will also present a brief overview on whether a small business should be valued and if so, how it is valued.


The meeting is free to members of the FBA. The cost is $10.00 for non members. Applications for FBA membership will be available at the door.


This activity has been approved for 1.0 hour of MCLE credit by the State Bar of California.
